General Terms and Conditions of Contract – (November 2014 Version)

1. Subject

These General Terms and Conditions of Contract govern the sale, both remotely and in person, of Tickets (as defined below) for national and international entertainment and/or cultural and sporting events, carried out by Ischia Eventi on behalf of the Organizer (as defined below).
The online publication of these General Terms and Conditions of Contract and the purchase order confirmation provided by Ischia Eventi to the Consumer shall be considered as the 'confirmation of the contract concluded on a durable medium' pursuant to Article 51, paragraph 7, of Legislative Decree No. 206/2005 ('Consumer Code').

 

2. Definitions

The following definitions apply to these General Terms and Conditions of Contract, it being understood that definitions in the plural shall apply to the corresponding singular term and vice versa:

Ischia Eventi: is Pointel Communication S.p.A., a joint-stock company and a leading provider on the island of Ischia of online services, marketing, information, and e-commerce for entertainment, sports, and culture. Customer: is the party who, through Ischia Eventi’s Services, purchases the Ticket from the Organizer electronically (e.g., websites and tablet/smartphone applications), by telephone, or through Ischia Eventi’s affiliated sales network.

Consumer: is the Customer who is a natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out."

 

Ischia Event Services: the services provided by Ischia Eventi in connection with the purchase and sale of Admission Tickets between the Customer and the Organizer, including the reservation of the Admission Ticket, its delivery or any other form of making the Admission Ticket available to the Customer, as well as any additional ancillary services related to the sale of the Admission Ticket, if requested by the Customer. In any case, this excludes the provision of the performance corresponding to the Event, which is the exclusive competence and responsibility of the Organizer, as identified in relation to each individual Event, on whose behalf and in whose name Ischia Eventi acts.

Ischia Event Services Contract: the contract established between Ischia Eventi and the Customer concerning the provision of Ischia Event Services, which is governed by these General Terms and Conditions, by the various requirements indicated during the individual stages of the remote purchase process, where applicable, and by the notices printed on the purchased Admission Ticket.

Sales Contract: the contract established between the Organizer and the Customer for the purchase and sale of the Admission Ticket, as a result of the provision of the Ischia Event Services governed by the Ischia Event Services Contract. Both contracts are governed by these General Terms and Conditions, by the various requirements indicated during the individual stages of the remote purchase process, where applicable, and by the notices printed on the Admission Ticket.

Contract: the Ischia Event Services Contract and the Sales Contract, considered jointly or separately as the case may be, governed by these General Terms and Conditions.

Admission Ticket Holder: the person who legitimately holds an Admission Ticket purchased by the Customer, in compliance with these General Terms and Conditions.

Event: the show, performance, or activity for which the Admission Ticket grants the Admission Ticket Holder the right of access.

Festival: the show, performance, or activity for which the Admission Ticket grants the right of access and during which several artists are scheduled to perform as part of the same Event.

Organizer: the entity organizing the Event for which the corresponding Admission Ticket has been issued, with whom the Sales Contract is concluded and on whose behalf and in whose name Ischia Eventi acts. Pursuant to Article 49 of the Consumer Code, the Organizer’s identification details are indicated in the “event info” section of the Ischia Eventi website page containing the Event description.

Admission Ticket: the document, including digital format, issued by Ischia Eventi that entitles the Admission Ticket Holder to access the Event Venue.

 

3. Admission Tickets and Events

3.1 All Admission Ticket Holders must possess a valid Admission Ticket to enter the Event Venue. The rules applicable to the Customer, as communicated in relation to the specific Event or otherwise applicable to the Customer or the Event, also apply to them.

3.2 The Admission Ticket must be purchased through the sales channels operated by Ischia Eventi or by an entity authorized by Ischia Eventi to market Admission Tickets. If the Admission Ticket was purchased by the Customer from subjects other than those indicated above, or if the Admission Ticket has been lost, stolen, duplicated, or obtained in violation of these General Terms and Conditions, the Admission Ticket Holder may be denied access to the Event Venue by the Organizer or may be required to leave it.

3.3 The Admission Ticket may not be transferred by the Customer for consideration, nor may it be subject to brokerage.

3.4 Ischia Eventi may at any time cancel, at the request of the Organizer and/or public authorities responsible for maintaining public order and safety, an Admission Ticket already issued or a purchase order already placed, whether for technical and/or organizational reasons (other than those set out in section 7 below) or in the event of issues relating to the actual payment by the Customer for the Admission Ticket.

In the event of cancellation, the Customer is entitled to a full refund of the price paid for the Admission Ticket as well as of any other fees paid to Ischia Eventi (including shipping fees, if shipping has not yet occurred) according to the procedures and timelines established by the Organizer, unless the cancellation arises from the Customer’s failure to make actual payment for the Admission Ticket.

3.5 Since Ischia Eventi does not constitute an exclusive distribution network nor the entity managing sales decisions for any given Event, it is not responsible for the type of seats made available for sale by the Organizer and does not guarantee that the Admission Tickets available through its sales channels represent, for each category, the best seats available at the time of purchase by the Customer, nor that better seats may not be released by the Organizer at a later time.

3.6 The price of the Admission Ticket is the one communicated by the Organizer and known to Ischia Eventi at the time the Customer completes the purchase transaction. Any lower price applied by the Organizer after the Customer’s purchase, whether for tickets of the same category or for Events taking place on specific dates, shall not entitle the Customer to a refund of the difference.

 

4. Payment Methods

Ischia Eventi reserves the right, for security reasons, to apply limitations and exclusions to the payment methods that the Customer may use for purchasing Admission Tickets.

Payments made with American Express and Diners Club credit cards are processed through the parent company CTS EVENTIM AG & Co. KGaA, Contrescarpe 75 A, D-28195 Bremen, Germany.

Payments made with Visa and Mastercard credit cards are processed through the group company CTS EVENTIM Nederland B.V., Postbus 69507, 1060 CN Amsterdam, Netherlands.


5. Ticket Price and Service Fees

The price of the Admission Tickets is the one shown on the Ticket itself, including any presale fees applied by the Organizer. Ischia Eventi applies service fees on each sales transaction as compensation for the Ischia Eventi Services, based on agreements with the Organizers and, in any case, at its own discretion. These fees are explicitly displayed in the most appropriate manner depending on the different sales channels used by Ischia Eventi.

The price of the Admission Tickets, as well as service fees, shipping costs, and any other price shown on the Ischia Eventi website, must be considered inclusive of the applicable VAT.


6. Right of Withdrawal

The Consumer acknowledges that, since the Contract concerns the provision of leisure-related products and services for which the supplier undertakes to provide them on a specific date or within a specified execution period, the right of withdrawal provided for by Article 52 of the Consumer Code does not apply.

The right of withdrawal does apply, however, to the distance sale of goods other than Admission Tickets, unless such goods fall within the categories for which the right of withdrawal is expressly excluded under Article 59 of the Consumer Code. In this case, the right of withdrawal may be exercised within 14 days from the date on which the Consumer has acquired physical possession of the purchased goods, by sending an explicit declaration of the decision to withdraw from the contract through the website: http://www.ischiaeventi.it/recesso

7. Postponed or Cancelled Event

7.1 Ischia Eventi, as a mere provider of Ischia Eventi Services and as an agent acting in the name and on behalf of the Organizer in relation to the sale of Admission Tickets, is under no circumstances responsible for any postponement or cancellation of the Event by the Organizer. In the event of a postponement or cancellation of the Event by the Organizer, Ischia Eventi will communicate to the Customer, on behalf of the Organizer, the actions adopted by the Organizer regarding the refund or replacement of the Admission Tickets related to the postponed or cancelled Event.

7.2 Without prejudice to the provisions of section 7.1, under no circumstances may the Customer request from Ischia Eventi a refund of service fees, any insurance coverage premium, shipping costs (if this delivery method for the Admission Tickets was chosen by the Customer), or the cost of any gift packaging selected by the Customer, as these amounts are remuneration for the already provided Ischia Eventi Services and are independent of the subsequent provision by the Organizer of the performance consisting of holding the Event.

It remains the exclusive responsibility of the Organizer to decide on any refund of the presale fee. The Customer acknowledges, for the purpose of being fully aware of their purchase decision, that the presale fees retained by the Organizer will not exceed 13% of the total price of the Admission Ticket.

If the Organizer announces the cancellation of the Event and the refund of the related Admission Ticket, and if delegated by the Organizer, Ischia Eventi will carry out the refund operations according to the timing and procedures decided by the Organizer and to the extent that the necessary funds have been received from the Organizer.

Admission Tickets for such Events cannot be exchanged for tickets to other Events.

7.3 In the case of an Event organized as a Festival, the listing of participating artists on the Ischia Eventi website is for informational purposes only. Therefore, if one or more artists listed as participants do not attend the Event or are replaced, such non-participation or replacement shall not be considered a cancellation of the Event, unless the Event is cancelled entirely by the Organizer.

7.4 In any case, Ischia Eventi will not replace an Admission Ticket if it is lost, misplaced, damaged, destroyed, stolen, or partially illegible because it was presented by the Customer in an imperfect condition.


8. Ticket Collection and Delivery Methods

8.1 In the case of electronic sales, the Customer may choose between: (i) delivery to their home (with the Customer bearing shipping costs, which will be communicated at the time of purchase), (ii) collection at the Event Venue on the day of the Event, and (iii) if made available by Ischia Eventi, printing the Admission Tickets at home, unless the Organizer requires mandatory shipping.

8.2 In the case of collection at the Event Venue or another location indicated by the Organizer, tickets may be collected starting at least one (1) hour before the Event begins.

8.3 If home delivery is requested, tickets will be delivered via express courier within a few days of purchase.

8.4 If home printing or digital ticket management is requested, the Customer must follow all specifications indicated on the website www.ticketone.it

10. Prohibitions

Admission Tickets may not be used for political, commercial, advertising, or other promotional purposes (for example, as prizes in competitions or lotteries), except in cases of prior written authorization from the Organizer and/or, if authorized by the Organizer, from Ischia Eventi.

The Customer who uses Admission Tickets in violation of this provision shall be liable for any damages resulting from their behavior and may face legal action.


11. General Provisions

11.1 Even if any of the provisions of these General Terms and Conditions of Contract are found to be unenforceable, the remaining provisions shall remain fully effective.

11.2 The Contract is governed by Italian law.

The Parties expressly agree that the United Nations Convention on Contracts for the International Sale of Goods, adopted in Vienna on April 11, 1980, shall not apply.

Any dispute arising out of or in connection with the Contract and these General Terms and Conditions of Contract shall be subject to the jurisdiction of the court of residence or domicile of the Consumer, or, in other cases, exclusively to the Court of Milan.

11.3 These General Terms and Conditions of Contract, the various provisions indicated during the distance sales process, where applicable, and the warnings on the Admission Ticket constitute the entire contractual agreement between the Customer and Ischia Eventi.

In the event of any conflict between the provisions of these General Terms and Conditions of Contract published in Italian and the corresponding English text published by Ischia Eventi, or in the event of a conflict between the Italian and English versions of any other content of the Contract, the Italian version shall prevail.
